HB 701 establishes January 1, 2022 as the starting date for legal cannabis sales at recreational dispensaries in Montana. Home cultivation will still be allowed, but adults are now limited to two plants (up to four per household). The bill also appoints a special administrative judge and establishes a dedicated court process specifically to expedite expungements for individuals with prior low-level marijuana offenses on their records. To become a medical marijuana patient in the state of Montana, you need to be an adult (18+) with a valid Montana drivers license and a debilitating condition that is recognised by the state. These conditions can be found in the Qualifying Conditions section below.

Cancer, glaucoma, positive status or human immunodeficiency virus, or acquired immune deficiency syndrome when the condition or disease results in symptoms that seriously and adversely affect the patient's health status
Cachexia or wasting syndrome
Severe chronic pain that is persistent pain of severe intensity that significantly interferes with daily activities as documented by the patient's treating physician intractable nausea or vomiting
Epilepsy or an intractable seizure disorder
Multiple sclerosis
Crohn's disease
Painful peripheral neuropathy
A central nervous system disorder resulting in chronic, painful spasticity or muscle spasms
Admittance into hospice care in accordance with rules adopted by the department
Post-traumatic Stress Disorder
Or any other medical condition or treatment for a medical condition approved by the legislature.
Registered cardholders and adults over the age of 21 can consume their cannabis in private. Consumption is not allowed on any school grounds, including buses, or on the grounds of any place of worship or correctional facility. Operating a vehicle, aircraft, or boat while under the influence is illegal.
